Measure Description

This measure is the percentage of code enforcement cases resolved within 60 days. The Code Compliance Division monitors and ensures all existing properties are being maintained and operated in compliance with applicable City regulations in order to ensure and protect the quality of life of residents, business owners, and property owners within the City. When a violation is noted (common violations include trash and debris on properties, grass exceeding 6”, commercial vehicles on properties, and unpaved parking), a property owner will be cited and given a certain number of days to come into compliance. The amount of time given is closely tied to the severity of the violation and the required time to achieve compliance.

Measure Importance

The City desires to rectify all violations as quickly as possible to reduce the number of visual eyesores and potential safety hazards within the City. The longer these violations go unabated, the more problems are created.

Explanation of Performance

The percent of code enforcement cases that get resolved within 60 days stands at 72%.  In FY17, the average code case was resolved within 30 days.  The cases not resolved administratively by staff are required to be adjudicated before a Special Magistrate.  This requires more time as a result of notice requirements, hearings and possibly additional time given by the Magistrate to allow a property owner to come into compliance.  The fewer cases that are adjudicated by the Special Magistrate, the better for the City as compliance with code violations is accelerated. Of the 14,000+ violations, nearly 20% now get adjudicated before the Special Magistrate, which is higher than the previous four-year average of 15.9%.  Overall, the number of code violations is decreasing in the City. Over the past two years, violations have decreased by 23%. Ideally, we would like to code cases and violations decrease as an indication that conditions are improving and West Palm Beach is becoming a cleaner and healthier city.
